USCIS has received a sufficient number of petitions needed to reach the congressionally mandated 65,000 H-1B visa regular cap and the 20,000 H-1B visa U.S. advanced degree exemption, known as the master's cap, for fiscal year (FY) 2024.
If the employee is currently in the U.S. and issued an I-797 Approval Notice approval notice with an attached I-94 the employee may begin or resume employment on the date noted on the approval notice.
What is cap fiscal year?
A: Under current laws, the USCIS may approve up to 65,000 new H-1Bs each fiscal year, plus an additional 20,000 for U.S.
Master's or higher degree graduates.
These limits are known as the H-1B Cap (“Cap”).
