What is the human right to adequate housing?
According to the U.N. Committee on Economic, Social, and Cultural Rights, which oversees the ICESCR, the human right to adequate housing consists of seven elements: (1) security of tenure; (2) availability of services, materials, and infrastructure; (3) affordability; (4) accessibility; (5) habitability; (6) location; and (7) cultural adequacy.
Should the right to housing be narrow or restrictive?
According to the United Nations’ Committee on Economic, Social and Cultural Rights (“CESC”), the right to housing should not be interpreted in a narrow or restrictive sense which equates it with, for example, the shelter provided by merely having a roof over one’s head or views shelter exclusively as a commodity.
Is housing a freestanding right?
Article 11 (1) of the International Covenant on Economic, Social and Cultural Rights (ICESCR) also guarantees the right to housing as part of the right to an adequate standard of living. In international human rights law the right to housing is regarded as a freestanding right.
Is there a right to housing in a state?
State law – In contrast to the federal constitution, there are a number of state constitutions that explicitly mention government housing or subsistence requirements. While a positive right to housing has not yet been found, there is potential that it could be found under state constitutional and statutory law.
